DMCA Policy

1. Overview

HamsterMath respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement that are reported to our designated copyright agent identified below.

2. Reporting Copyright Infringement

If you believe that content available on or through the HamsterMath website infringes your copyright, please submit a DMCA takedown notice containing the following information:

  1. Identification of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
  2. Identification of the infringing material and information reasonably sufficient to permit us to locate the material on our website (e.g., the URL of the page containing the material).
  3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature (or that of a person authorized to act on your behalf).

3. Where to Send DMCA Notices

4. Processing of Notices

Upon receipt of a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material promptly;
  • Notify the content provider, if applicable, that the material has been removed;
  • In appropriate circumstances, terminate the accounts of repeat infringers.

5. Counter-Notification

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification containing the following:

  1. Identification of the material that was removed and the location at which it appeared before removal.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number.
  4. A statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the United States, any judicial district in which HamsterMath may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your physical or electronic signature.

6. Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, the access of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or update, transfer, suspend, or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Good Faith Warning

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
